TRULY HARD SELTZER CANADA x THE GIST - SEARCH FOR CANADA’S NEXT GREAT HOCKEY CREATOR CONTEST (the “Contest”) RULES & REGULATIONS

NO PURCHASE OR PAYMENT NECESSARY TO ENTER FOR A CHANCE TO WIN.

1. CONTEST PERIOD

The Contest commences at 12:00 a.m. Eastern Time (“ET”) on April 4, 2025, and ends at 11:59 p.m. ET on April 30, 2025 (the “Contest Period”). This Contest is brought to you by Moosehead Breweries Limited (the “Contest Sponsor”). No purchase necessary.

2. ELIGIBILITY

To enter the Contest and be eligible to win the Prize (see rule 5), a person (“Entrant”) must be a legal Canadian resident (excluding the provinces of Quebec, Yukon, NWT and Nunavut) who is twenty-one (21) years old or older at the time of Contest entry. Notwithstanding the above, this Contest is not open to employees, officers, directors, agents, and representatives of the Contest Sponsor, The GIST, the National Hockey League (“NHL”), its member clubs, NHL Enterprises, L.P., NHL Enterprises Canada, L.P., NHL Enterprises B.V., NHL Interactive CyberEnterprises, LLC (the foregoing NHL entities collectively, the “NHL Entities”), or their divisions, subsidiaries, affiliates, advertising and promotional agencies, Contest suppliers and judges, employees and contractors of the provincial liquor agencies, liquor licensees and their employees, and members of their immediate families (parents, siblings, spouses) and those with whom they are domiciled.

3. AGREEMENT TO BE LEGALLY BOUND BY RULES

By participating in this Contest, you are agreeing that you: a) have read and understand these rules, b) meet the Contest eligibility requirements, c) agree to be legally bound by these rules, and d) agree to comply with, and abide by, the rules and the decisions of the Contest Sponsor, whose decisions shall be final and binding.

The Contest Entities (as defined below) are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed or incomplete entries (all of which are void).

4. HOW TO ENTER

To earn one (1) entry in the Contest during the Contest Period, Entrants must complete and submit the form on the Contest landing page at thegistsports.com. The form will require details about the Entrant, their passion for hockey, and why they are the right fit for this opportunity. Entrants must also provide examples of their content, either by linking to past work or submitting a video created specifically for this Contest. Entrants must follow the Truly Hard Seltzer Canada Instagram account (@trulycan_) and The Gist Instagram account (@thegistca) as part of the application process. Additionally, Entrants must ensure their Instagram account is set to public (not private). Only one (1) Instagram account may be used to participate, and comments must comply with Instagram's Community Guidelines and Contest rules.

Finalist Selection & Winner Determination

  • Three (3) finalists will be selected and asked to create an Instagram Reel showcasing their content creation skills, their love of Truly and their passion for becoming Canada’s Next Great Hockey Creator. This Reel will be posted as a collaborative post with Truly Hard Seltzer Canada.
  • The 3 finalists will be under the direction of the Sponsor (Truly), and additional guidelines, parameters, conditions, etc. will apply.
  • Finalists will also participate in a video call interview with the judging panel. A panel of judges will evaluate the content and interviews to select one (1) grand prize winner. The shortlist will be judged based on the final produced Instagram Reel (/5), creativity (/5), project fit (/5), and interview (/5).

Entry Limit: Each person may enter only once, using one (1) email address and one (1) Instagram account. Additional entries will not be counted.

The Contest Sponsor reserves the right to disqualify entries that it deems in its sole discretion to be harmful to individual users, Contest Sponsor, The GIST, the NHL Entities, the communities that make up Moosehead Breweries, or any rights (including proprietary rights) of the Contest Sponsor, the NHL Entities or their affiliates or any other party, including any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful or racially-offensive, ethnically-offensive, or otherwise objectionable material of any kind, including but not limited to any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, provincial, national, federal or international law.

Filming Guidelines: The Entrant must keep the following guidelines in mind to ensure the content is suitable for all social media platforms:

  1. Background Considerations:Avoid including paintings, posters, professional photography, or any other forms of artwork in the background of their submission. The focus should remain on the Entrant’s message, so it is advisable to choose a simple, uncluttered backdrop.
  1. Audio:

Refrain from including background music, television audio, or any other sound that may distract from the message. While creativity and self-expression are encouraged, less is often more when it comes to the background elements.

  1. Distractions:

Be mindful that content may be shared on various platforms, including but not limited to Instagram, Facebook, and television. As such, it is important to consider potential interruptions, such as other individuals while filming. Pets are welcome to be part of the submission, but please ensure that human interruptions are minimized during the recording process.

5. PRIZE

There are three (3) prize packages to be awarded (the “Prizes”).

Three finalists will be selected by a panel of judges. The shortlist will be selected based on their passion for hockey (/5), project fit (/5), brand fit (/5), social content (/5). Creators must follow @trulycan_ and @thegistca on Instagram. .

  • The selected finalists will each be asked to create an Instagram Reel that brings to life their love of hockey, their love of Truly and their passion for becoming Canada’s Next Great Hockey Creator. Reels will be posted in collaboration with @trulycan_.
  • Finalists will also participate in a video call interview with the judging panel.
  • The shortlist will be judged based on the final produced Instagram Reel (/5), creativity (/5), project fit (/5), and interview (/5).
  • A panel of judges will evaluate the content and interviews to select one (1) grand prize winner.
  • The two [2] finalists who are not selected will be compensated for their time with a $2,500 honorarium.

The [1] Grand Prize has an approximate retail value of $10,000 CAD, and consists of:

  • A $10,000 honorarium
  • The opportunity to create credited hockey-related content (four (4) pieces total) for both Truly & The GIST, which will be amplified with paid media to reach a broader demographic
  • Profile opportunities within The GIST, including a podcast interview
  • A trip for 2 to the 2025 Stanley Cup® Final
  • Access to exclusive NHL® opportunities
  • Two [2] quarterly home deliveries of Truly Hard Seltzer

The Contest Sponsor, together with its promotional, marketing or advertising agents and affiliated companies, reserves the right to withdraw, amend or terminate this Contest, at any time without prior notice. Unclaimed Prizes will not be awarded. Return of a Prize as undeliverable may result in disqualification.

Acceptance of the Prize constitutes permission for the Contest Sponsor, The GIST, the NHL Entities, and their respective agencies and designees to use the winner’s name and/or likeness along with any applicable materials used as a part of their submission for advertising and promotional purposes without additional compensation, unless prohibited by law. The Contest Entities are not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the Prize.

Without limiting the generality of the foregoing, the following general conditions apply to the Prize: (i) Prize must be accepted as awarded and is not transferable, assignable and/or convertible to cash (except as may be specifically permitted by Contest Sponsor in its sole and absolute discretion); (ii) no substitutions are permitted, except at Contest Sponsor’s option; (iii) the costs of everything not specifically and expressly stated above as included in the Prize are the sole and absolute responsibility of the confirmed Prize winner; (iv) if the confirmed Prize winner does not utilize any part(s) of the Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Contest Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (v) Contest Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Prize or any component thereof; and (b) substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Contest Sponsor’s sole discretion, a cash award; (vi) by accepting the Prize, the confirmed Prize winner agrees to waive all recourse against the Contest Entities if the Prize or a component thereof does not prove satisfactory, either in whole or in part; and (vii) the confirmed Prize winner is not entitled to the monetary difference between actual Prize value and approximate Prize value, if any.

6. PRIZE NOTIFICATION

At approximately 2:00 p.m. ET on May 5, 2025 (“Finalist Date”), three (3) finalist Prize winners will be selected from all eligible entries received at the Contest Sponsor’s offices at 89 Main Street West, Saint John, NB.

At approximately 2:00 p.m. ET on May 26, 2025 (“Contest Date”), one (1) potential grand prize winner will be selected from the finalist entries received at the Contest Sponsor’s offices at 89 Main Street West, Saint John, NB.

Contest Sponsor will attempt to contact the potential Prize winner by email (“Initial Notification”), with further information on how to claim the Prize. If the potential Prize winner cannot be reached or fails to respond to the Initial Notification, for whatever reason, within three (3) days of the Finalist Date and Contest Date, another potential Prize winner may be selected from the remaining eligible entries or the Contest may be cancelled at Contest Sponsor’s sole discretion. Odds of being selected to win the Prize will depend on the total number of eligible entries received during the Contest Period.

The winner of the Contest will be chosen based on a combination of criteria, including the creativity and quality of the submission. In addition to these criteria, the Contest Sponsor team will conduct a vote to determine the final winner. This vote will take into consideration the overall appeal, originality, and alignment with the Contest's objectives. The decision of the Contest Sponsor team is final.

NO ONE IS A PRIZE WINNER UNLESS AND UNTIL THE SPONSOR OFFICIALLY CONFIRMS HIM/HER AS THE PRIZE WINNER IN ACCORDANCE WITH THESE RULES.

Before being declared a Prize winner, each potential Prize winner must provide proof of identification, correctly answer, unaided, a time-limited, mathematical skill-testing question posed by email at a mutually-convenient time, and complete, sign and return a Declaration and Release Form (and any other documents, as applicable) within two (2) days of receiving the Declaration and Release Form (the “Prize Claim Date”). If a potential Prize winner cannot be reached within the timeframe specified above, is not in compliance with these Contest rules, incorrectly answers the skill-testing question, declines the Prize, email correspondence between Contest Sponsor and potential Prize winner is returned as undeliverable without a forwarding address, or fails to return the Declaration and Release Form (and any other documents, as applicable) by the Prize Claim Date, the Prize may not be awarded and Contest Sponsor reserves the right to select another potential Prize winner from the remaining eligible entries at Contest Sponsor’s sole discretion.

7. GENERAL

In the event of any dispute regarding the interpretation of these Contest rules, the decision or interpretation of the Contest Sponsor shall prevail. All entries become the property of the Contest Sponsor. Any entry that is illegible, incomplete, altered, or contains false information, is invalid. Contest Entities are not responsible for lost, stolen, delayed, damaged or misdirected claims or entries or for any problems or technical malfunction of any internet or telephone network or broadcast transmission during the Contest Period. The Contest Entities are not responsible for any errors or omissions with respect to the printing or advertising of this Contest and Contest Sponsor reserves the right to withdraw, amend or cancel this Contest, in the event of a printing or administrative error. The Contest Sponsor in its sole discretion may withdraw, amend, cancel, suspend, terminate or modify this Contest in any way, 

in whole or in part, without notice, for any reason including if it determines in its sole discretion that this Contest is no longer capable of running as intended, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause of any nature whatsoever. The Contest Entities accept no responsibility for loss, damage or claims caused by the awarded Prize or the Contest itself. By entering, an Entrant releases and holds harmless the Contest Sponsor, The GIST, the NHL Entities, their affiliated and related companies and advertising, promotional agencies and all of their respective directors, officers, members, shareholders, employees, agents, representatives, successors and assigns (collectively, the “Contest Entities”) from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Contest or any Prize won. Winner must comply with any applicable manufacturer warranty, terms and conditions and/or user guide for any Prize won. Without limiting the release of liability provisions herein, and for greater certainty, the Contest Entities will not be liable for: a) any incorrect or inaccurate information, whether caused by users of the Contest or by any equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of entries in the Contest; b) any error, omission, interruption, deletion, defect or delay in the operation of the Contest or any transmission in connection with the Contest; c) any communications line failure, theft, destruction or unauthorized access to, or alteration of entries; d) any problems with, or technical malfunction of, any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, or failure of email which may occur for any reason whatsoever, including technical problems or traffic congestion on the Internet or at any website or combination thereof; or e) any injury or damage to Entrant’s or to any other person's computer related to or resulting from participating or downloading materials in this Contest.

Entrants may be required to provide the Contest Sponsor with proof that he/she is the Authorized Account Holder of the email address associated with the entry submitted. The Contest Sponsor reserves the right at its sole discretion to disqualify any individual from the Contest, and to ban that individual from participation in any future promotion of the Contest Sponsor, if the Contest Sponsor finds or believes such individual to be tampering with the entry process or the operation of the Contest or where applicable to be acting in violation of the Contest rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass the Contest Sponsor, the Contest Sponsor’s agencies, The GIST, the NHL Entities, other Entrants or any other person. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE CONTEST SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. The Contest Sponsor’s failure to enforce any term of these Contest rules shall not constitute a waiver of that provision.

By entering the Contest, you acknowledge and agree that the Sponsor and participating companies (which includes the Contest Sponsor, The GIST, and the NHL Entities) may use your contact information—such as email address, phone number, and mailing address—for general solicitation, marketing, or other business and promotional activities related to their services and products. You may revoke this consent at any time by providing written notice to the Sponsor and participating companies or by using the unsubscribe link provided. Please note that opting out applies only to marketing communications and does not affect transactional messages, including those related to your entry.

Additionally, by entering this Contest, you consent to the use of your name, place of residence, photograph, or likeness by the Contest Sponsor, The GIST, the NHL Entities, and their agencies or designees for publicity, advertising, or informational purposes in any media, including the Internet, worldwide and in perpetuity, without further compensation, notification, or permission, unless prohibited by law. Participation signifies compliance with the Contest rules. This Contest is subject to all applicable laws and governed by the laws of the Province of New Brunswick and Canada. If any provision is deemed invalid, illegal, or unenforceable, the remaining terms shall remain in effect and be interpreted as if the invalid provision were not included.

Further, you acknowledge that as the Entrant, you will retain full ownership of the submitted content, including all intellectual property rights. However, by submitting your photos or videos, you grant the Contest Sponsor a sublicensable, exclusive, worldwide right to use, distribute, reproduce, display, and modify the content in connection with the Contest and for any promotional, marketing, or commercial purposes. This exclusive right includes the ability to sublicense the content to third parties for these purposes, as deemed appropriate by the Contest Sponsor. This license will remain in effect for the duration of the Contest and any future promotional activities related to the Contest.

The provincial liquor agencies are not connected with this Contest in any manner whatsoever and are not liable in any way whatsoever in regard to any matter which relates to this Contest.

The Contest is in no way sponsored, endorsed, or administered by, or associated with any social media website. You understand that you are providing your information to the Contest Sponsor and not to a social media website.
